By accessing or using MemoryOS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. MemoryOS is operated by Frank Kurka ("we," "us," "our").
MemoryOS is a multi-model AI chat platform that allows you to converse with AI models from multiple providers, save conversations, search your history, and export content to various destinations. The Service offers both free (BYOK — Bring Your Own Key) and paid tiers.
You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your account credentials. You may not impersonate another person or use a false email address. We reserve the right to suspend or terminate accounts that violate these terms.
When using BYOK mode, you provide your own API keys from third-party AI providers (Anthropic, OpenAI, Google, etc.). These keys are stored in your browser's local storage and are sent directly to the respective AI providers. We do not store, log, or have access to your API keys on our servers. You are responsible for managing your own API key usage and costs with those providers.
Paid subscribers access AI models through our server-side API keys. Usage is subject to daily prompt limits as described in our pricing. We reserve the right to adjust rate limits to prevent abuse. Payments are processed through Stripe. All sales are final unless otherwise required by law.

Your conversations belong to you. We claim no ownership over the content you create or store through MemoryOS. You retain all rights to your conversations, exports, and published content. The MemoryOS software, design, branding, and Export Matrix are the intellectual property of Frank Kurka.
When you send messages through MemoryOS, those messages are forwarded to the AI provider you selected (Anthropic, OpenAI, Google, etc.). Each provider has its own terms of service and privacy policy that apply to your use of their models. We are not responsible for the responses generated by third-party AI models.
Please refer to our Privacy Policy for detailed information about how we handle your data. In summary: conversations may be stored locally in your browser, in our cloud (Cloudflare R2), or exported to destinations you choose via the Export Matrix.
We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind. We may perform maintenance, updates, or modifications that temporarily affect availability.
To the maximum extent permitted by law, MemoryOS and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You may stop using the Service at any time. We may suspend or terminate your access for violation of these terms. Upon termination, you may export your data via the Export Matrix. We will retain your data for 30 days after account termination before permanent deletion.
We may update these terms from time to time. Material changes will be communicated via the email address associated with your account. Continued use of the Service after changes constitutes acceptance of the updated terms.
